Ruling made in controversial Tennessee school voucher suit

MEMPHIS, Tenn. (WMC) - The Tennessee Court of Appeals ruled in favor of state officials Wednesday in a lawsuit alleging Tennessee’s 2019 school voucher law hurts public schools in Shelby and Davidson counties.

The trial court granted the motion to dismiss the suit after determining that the Tennessee Education Savings Account Pilot Program (ESA Act) has not caused any unequal hardship to public schools in Shelby and Davidson counties.

A group of taxpayers and parents in the two counties sued state officials in 2020, claiming that the ESA Act violates the Tennessee Constitution and state law by diverting taxpayer funds from public schools to private schools.

A group of parents with children eligible for the ESA Act, and another unspecified group intervened in defense of the act and filed motions to dismiss alongside state officials.
